These Terms & Conditions (“Agreement”) govern your purchase of wedding videography services (“Services”) from Frame Wedding Film (“Company,” “we,” “us,” or “our”). By booking our Services or making any payment, you agree to be bound by this Agreement. If you do not agree to these terms, please do not proceed with booking.
1. Definitions and Scope
1.1. Client: The individual(s) or couple contracting Frame Wedding Film’s wedding cinematography, documentary-style wedding films, highlight reels, or other 4K wedding videography services.
1.2. Event: The wedding day or series of events (e.g., engagement session, rehearsal dinner, ceremony, reception) for which Services are booked.
1.3. Deliverables: Final edited video files (e.g., Feature Film, Highlight Film, Reels, Trailer) provided in 4K resolution, along with any raw footage or additional media as specified in the selected package.
1.4. Booking Deposit: A non-refundable initial payment required to secure the Event date and hold the Company’s availability.
1.5. Balance: Remaining payment due no later than 14 days before the Event date, unless otherwise agreed in writing.
1.6. Location: The physical venue(s) where the wedding or related events take place, including destination locations (e.g., Riviera Maya, Mexico).
2. Booking and Payments
2.1. Reservation and Deposit:

To confirm our availability for your wedding date, you must sign this Agreement and pay a non-refundable Booking Deposit of 30% of the total service fee.

The date is not secured until we receive the signed Agreement and Deposit.
2.2. Payment Schedule:
-
Booking Deposit (30%): Due upon signing this Agreement.
-
Balance (70%): Due no later than 14 days prior to the Event date. If the balance is not paid by this deadline, Frame Wedding Film reserves the right to cancel Services and retain the Deposit.
2.3. Accepted Payment Methods: Bank transfer, credit card (Visa, MasterCard, American Express), PayPal, or other methods as agreed in writing. Any transaction fees are the Client’s responsibility.
2.4. Late Payment:

A late fee of 5% of the outstanding balance will apply for payments received after the due date.

If payment is not received within 7 days of the due date, Frame Wedding Film may suspend Services and/or withhold Deliverables until full payment is made.
3. Changes, Cancellations, and Refunds
3.1. Client Rescheduling:

If you request to reschedule the Event date more than 30 days prior to the original date, we will make reasonable efforts to accommodate, subject to availability. Additional fees may apply.

If rescheduling is requested within 30 days of the Event, the Booking Deposit is forfeited, and a new Deposit is required to confirm the new date.
3.2. Client Cancellation:

Written notice of cancellation must be provided.
-
More than 60 days before Event: Booking Deposit is forfeited; no further balance is due.

30–60 days before Event: Client forfeits 50% of the total service fee (Booking Deposit plus an additional 20%).

Less than 30 days before Event: Client is responsible for 100% of the total service fee; no refunds.
3.3. Company Cancellation:

In the unlikely event that Frame Wedding Film must cancel due to unforeseen circumstances (e.g., illness, equipment failure, natural disaster), we will provide a full refund of all payments received or offer to transfer all fees toward a new date. We are not liable for additional expenses (travel, accommodation, or other vendor costs).
3.4. Force Majeure:

Neither party is liable for delays or non-performance caused by events beyond reasonable control (e.g., natural disasters, acts of government, pandemics). In such cases, we will reschedule or refund deposits at our discretion.
4. Services, Deliverables, and Timelines
4.1. Scope of Services:

As per the chosen package (e.g., Coming Soon Trailer, Highlights Film, Feature Film, Vertical Reels).
-
Services include pre-event consultation, full-day or partial-day filming (as specified), editing, color grading, audio mixing, and delivery of final Deliverables in 4K digital format.
-
Drone footage is included where permitted by local regulations; the Client is responsible for securing any necessary drone permits.
4.2. Filming Location and Conditions:
-
Client must ensure appropriate permissions for all shooting locations (venues, public spaces). Any additional fees (venue fees, drone permits, parking, location permits) are the Client’s responsibility.

Frame Wedding Film’s crew requires access to electricity for charging equipment. If no power is available, Client agrees to provide backup power or appropriate alternatives.
4.3. Deliverable Timeline:

Coming Soon Trailer: Delivered within 5 business days after the Event.
-
Highlights Film: Delivered within 4–6 weeks after the Event.
-
Feature Film: Delivered within 8–12 weeks after the Event (for one-day weddings). Additional time may apply for multi-day celebrations.

Vertical Reels: Delivered within 10 business days after the Event.
4.4. Revisions:
-
The Client is entitled to up to two rounds of minor revisions (e.g., color tweaks, audio adjustments) for each Deliverable, to be requested within 14 days of receiving the draft.

Major changes (e.g., re-editing sequences, adding substantial new footage) are subject to additional fees at Scope Edit Rate: $150 USD per hour.
4.5. Final Approval:

Client must provide written approval (email or digital signature) for final Deliverables. Once approved, Frame Wedding Film will release the high-resolution video files; no further changes are included unless separately contracted.
5. Usage Rights, Copyright, and Licensing
5.1. Ownership:
-
Frame Wedding Film retains full copyright to all raw footage and edited videos.

We grant the Client a perpetual, non-exclusive, worldwide license to use, reproduce, and display the final Deliverables for personal use (e.g., social media, personal archives).
5.2. Third-Party Licensing:

Music: We use licensed music tracks for soundtracks. Client agrees not to remove or alter any copyright notices. Additional client-selected music may require separate licensing.

Stock Footage/Images: Any third-party stock footage or images used are covered under our licensing; Client may not repurpose them beyond the confines of the Deliverables without additional licensing from the original provider.
5.3. Promotional Use:

Frame Wedding Film may use final and raw footage (with Client’s permission) for marketing, portfolio display, website, social media, competitions, and film festivals. If the Client opts out, they must notify us in writing at least 30 days before the Event.
5.4. Client-Provided Content:

Any photos, videos, or materials provided by the Client become part of the project. The Client certifies they have the legal right to grant usage of such materials. Frame Wedding Film is not liable for unauthorized third-party content.
6. Liability and Indemnification
6.1. Limitation of Liability:

To the fullest extent permitted by law, Frame Wedding Film’s total liability for any claim under this Agreement is limited to the amount of fees paid by the Client.

We are not responsible for any indirect, consequential, or special damages, including lost profits or emotional distress, arising from our Services.

In the event of equipment failure, data corruption, or other unforeseen issues resulting in loss of footage, we will make all reasonable efforts to recover or reshoot. If recovery is not possible, our liability is limited to a full refund of all payments received.
6.2. Client Responsibilities:

The Client must provide accurate information about the Event, including schedules, locations, and any required permits.

The Client is responsible for the safety and welfare of Frame Wedding Film’s crew and equipment. Should any damage, theft, or injury occur due to the Client’s negligence, the Client will be liable for all related costs.
6.3. Indemnification:

The Client agrees to indemnify, defend, and hold harmless Frame Wedding Film, its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or in connection with:
a) Any breach of this Agreement by the Client.
b) Unauthorized use of third-party content.
c) Injuries or damages caused during the Event to personnel or equipment due to the Client’s negligence.
7. Privacy and Data Protection
7.1. Privacy Policy: Our collection and use of personal data are governed by our Privacy Policy, available at https://www.frameweddingfilm.com/privacy. By booking Services, the Client consents to our Privacy Policy terms.
7.2. Model Releases: If the Event includes individuals other than the Client (family members, guests, wedding party), the Client is responsible for obtaining any necessary model releases or consents for their image and likeness.
8. Client Cooperation and Consultation
8.1. Pre-Event Consultation: We offer one pre-Event consultation (in-person or virtual) to discuss shot lists, schedules, and creative vision. Additional consultations are available at our hourly editing rate of $150 USD.
8.2. Day-Of Cooperation: The Client or designated point of contact must provide timely direction, ensure access to venues, and coordinate with other vendors to facilitate smooth filming.
9. Warranties and Disclaimer
9.1. Frames & Angles: While we strive for cinematic perfection, actual angles, and coverage depend on venue constraints, lighting, and timing.
9.2. Quality Guarantee: We guarantee professional-grade 4K delivery and artistic editing. However, minor imperfections, lighting variances, or weather-related issues are understood as inherent to live-event filming and do not constitute a breach of contract.
10. Governing Law and Dispute Resolution
10.1. Governing Law: This Agreement is governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law principles.
10.2. Dispute Resolution: Any dispute arising out of or relating to this Agreement shall be resolved first through good-faith negotiation. If unresolved within 30 days, the dispute will be submitted to binding arbitration under the rules of the Mexican Arbitration Center (Centro de Arbitraje). The arbitration will be conducted in Spanish in Cancún, Quintana Roo. Judgment on the arbitral award may be entered in any court with jurisdiction.
11. Severability and Waiver
11.1. If any provision of this Agreement is deemed invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
11.2. No waiver of any breach or default under this Agreement shall be deemed a waiver of any subsequent breach or default.
